Presidential Statements on GBVF: Understanding the Difference Between Political Commitment and Law

What does a presidential statement on GBVF mean in law?

A presidential statement may express government policy, political commitment or an intention to act. However, a presidential statement does not, by itself, amend legislation, create a criminal offence, change bail provisions or alter criminal sentences.

Where changes to legislation are required, they must proceed through the applicable constitutional and parliamentary law-making process before becoming enforceable as law.

Imveli's Position

Imveli Research, Training & Awareness welcomes the President's continued public focus on gender-based violence and sexual violence.

Imveli regards strong political commitment to addressing GBVF as important and calls for that commitment to be translated into concrete legislative, policy and institutional action where required.

The scale and persistence of GBVF require sustained implementation, adequate resources and measurable action within the framework of the Constitution and the law.

The Key Distinction

STATEMENT OF INTENT ≠ LAW

Understanding this distinction helps the public follow the legislative process, participate meaningfully and hold institutions accountable for commitments made.
